29th JUDICIAL DISTRICT COURT FOR THE PARISH OF ST. CHARLES
STATE OF LOUISIANA
IN RE: COVID-19
The Court, considering the Executive Order issued by Parish President Matthew Jewell on March 20, 2020, and further considering Executive Department Proclamations JBE 2020-25, JBE 2020-27, JBE 2020-30 and Stay at Home Order dated March 22, 2020, issued by Governor John Bel Edwards, together with the Louisiana Supreme Court Order issued by Chief Justice Bernette Johnson on March 16, 2020, and for protection of the health of court staff, judicial officers, and litigants; and, therefore, acting in accordance with Article V, Section 1 of the Louisiana Constitution and Louisiana Revised Statute 1:55, the Chief Judge, acting on behalf of the Judges of the 29th Judicial District Court, issues the following orders, to-wit:
IT IS ORDERED that, effective immediately, the offices of the 29th Judicial District Court are closed to the public until April 13, 2020 at 8:30 a.m. Instructions are provided hereinbelow.
IT IS FURTHER ORDERED that Jurors noticed to appear during the closure are dismissed.
IT IS FURTHER ORDERED that all jury trials in each division of Court are suspended until May 18, 2020.
IT IS FURTHER ORDERED that all civil matters set during this closure are directed to contact the division in which the matter is scheduled for instructions.
IT IS FURTHER ORDERED that all juvenile matters set during this closure are directed to contact the division in which the matter is scheduled for instructions.
IT IS FURTHER ORDERED that in criminal matters for incarcerated individuals, initial appearances, arraignments, and bond hearings shall proceed and may be held by audio-video transmission as permitted by Rule XIX of the 29th Judicial District Court.
IT IS FURTHER ORDERED that the Court may conduct criminal proceedings by simultaneous audio-visual transmission as permitted by Rule XIX of the 29th Judicial District Court.
IT IS FURTHER ORDERED that, at the Court’s discretion, proceedings in emergency and time-sensitive matters may be conducted by simultaneous audio-visual transmission as permitted by Rule XIX of the 29th Judicial District Court. Subject to this Court’s Administrative Order of March 13, 2020 and the Executive Order of Parish President Matt Jewell issued on March 20, 2020, this Order does not prohibit the Court from conducting limited proceedings for emergency and time sensitive matters where teleconference or simultaneous audio-visual transmission is not feasible.
IT IS FURTHER ORDERED that non-emergency civil and criminal pleadings should be filed by facsimile (fax #: 985-783-2005) and U.S. Mail (Clerk of Court, 15045 River Road, Hahnville, Louisiana 70057). Contact the Court for further filing instructions (tel. # 983-783-6632).
IT IS FURTHER ORDERED that emergency filings and/or those filings which cannot be accomplished by facsimile filing, shall be filed with the Clerk of Court’s office. The Clerk of Court is available to accept filings during normal business hours of 8:30 a.m. to 4:30 p.m. Monday through Friday (except legal holidays). IT IS FURTHER ORDERED that, at the court’s discretion, action may be taken on emergency petitions and motions filed by facsimile and prior to receipt of the original filing during this closure.
IT IS FURTHER ORDERED that any and all fines, fees and/or court costs payable to Bonds and Fines due between March 23, 2020 and April 13, 2020, are deferred and will not be due until April 13, 2020.
IT IS FURTHER ORDERED that, in every proceeding conducted pursuant to this Order, it shall be recorded in the official transcript and minute record that the proceeding was conducted pursuant to the March 23, 2020 Emergency Order of the 29th Judicial District Court.
IT IS FURTHER ORDERED that, unless supplemented or amended or otherwise expressly set forth herein, the foregoing shall remain in effect until April 12, 2020.
